PPP模式在中国高等教育发展中的应用及法学思考

Public-private partnership in China's higher education:An application-oriented legal analysis

基于提升高等教育发展水平和推进国家创新治理体系的建设需求,PPP模式逐渐成为推动高等教育改革创新的手段之一。PPP模式在基础设施建设领域的运用日臻成熟,但在教育类尤其是高等教育范畴中的应用仍处于初始阶段。文章在分析高等教育应用PPP模式的必要性和可行性的基础上,围绕法律进路和契约安排两条主线分别论述PPP模式在高等教育应用中存在的各类问题及应对方式,试图为高等教育PPP项目的顺利发展提供策略建议。

Based on the needs for improving the standards of higher education development and promoting national innovation system and infrastructure, PPP has gradually become one of the most important means to propel innovation and reform in higher education. The application of PPP in infrastructure construction is becoming more and more mature, but its application in the field of education especially higher education is still in an initial stage. This paper analyzed the necessity and feasibility of PPP＇ s application in higher education and discussed the problems and corresponding solutions based on two important aspects of legal approach and contractual arrangement, and tried to provide suggestions for the development of PPP in higher education.
