Logic,Dilemmas and Regulations: An Examination of Power's Boundaries of Relationship between Government and University

权力与利益如影随形。在大学外部治理中,"府学关系"的核心问题在于厘清政府与大学的权力边界。从大学出发与从政府出发的逻辑起点,前者强调高深知识,后者注重公共利益。行政利益施压与"诱惑"下,以致大学与政府间的权力边界陷入模糊的样态,即:显性层面,行政权力越轨而行;隐性层面,行政文化与制度惯性侵蚀大学自主权。实现大学与政府的共同利益,需界定二者的权力边界,厘清权力归属。坚持落实简政与放权政策,强化权威认同与落实自主权,完善程序与法治调控体系,以提供更优质的高等教育服务。

Power is derived from interests. The key point of the ＂relationship between government and university＂ lies in the redef- inition of power＇ s boundaries of government and university in the external management of university . From the logical angle of univer- sity and government, the former stresses profound knowledge and the latter focuses on public interest. Due to the pressure and tempta- tion of administrative benefits, the power boundary between university and government has fallen into the fuzzy state, namely, on the dominant level, public power is beyond the boundary; on the hidden level, universities＇ self - determination right is eroded by admin- istrative culture and system inertia. To achieve the same interests of university and government, the power boundary between the two should be defined and right ownerships should be clarified. This paper puts forwards insisting on the policy of simplifying administration and delegating power, ensuring the authority to implement identity and autonomy and improving the procedures and law regulation sys- tem in order to provide better quality service in higher education.
