中国特色社会主义法治道路的独特性及内在根据 被引量:2

摘要 中国特色社会主义法治道路呈现鲜明的"中国特色",从而体现出明显的独特性。从"三个独特"即独特的文化传统、独特的历史命运、独特的基本国情角度阐发中国特色社会主义法治道路具有重要的理论价值,有助于正确认识法治道路的唯一性与多样性的关系、中国法治道路的"独特性"与人类法治"一般性"的关系。中国特色社会主义法治道路的独特性具体体现在三个方面:实现方式上具有强烈的顶层推动特征;方法手段上具有独特的德法互补特征;发展途径上具有明显的渐进稳健特征。其内在根据是:历史惯性和实践证明了顶层推动的必要性;中华文化为"德""法"融合提供了深厚的土壤;现实国情要求法治建设必须渐进稳健。从中可以进一步看出研究中国特色社会主义法治道路的方法论问题,即要从中国的客观实际而不是抽象的理论出发;要从中国道路整体性而不是单纯的法学角度出发。 The road of socialist rule of law with Chinese characteristics has distinct "Chinese characteristics" and shows its apparent distinctiveness. It is very important in theory to clarify the road of socialist rule of law with Chinese characteristics from the perspective of "Three Kinds of Distinctiveness" including the distinctive cultural tradition, distinctive historical destiny and distinctive national condition. And it is very helpful to correctly understand the relation between distinctiveness and diversity in the road of rule of law, and the relation between "distinctiveness" of Chinese socialist rule of law and "generality" of rule of law in human society. The specific distinctiveness of the road of socialist rule of law with Chinese characteristics is represented in three aspects:(1)The strong top-level drive is the main manner to realize the socialist rule of law; (2)Morality and law supplement each other and (3) The obvious progressive and steady steps form the approach of development. Its inherent basis relies on following facts: (1)The historical tradition and practices have proved the necessity of the "top-level drive". (2)Chinese culture provides a deep soil for the integration of "morality" and "law"; and (3)The real national conditions require that the construction of the rule of law must be steady and gradual. In this manner, we can further understand the methodological issue, namely, we must study the road of socialist rule of law with Chinese characteristics from the reality of China rather than any abstract theories,and from the entirety of Chinese road rather than any simple or pure view of science of law.
