技术中立原则在信息网络传播权保护领域的适用

The Application of Technology Neutrality Principle in the Protection of Information Transmission Right

网络技术的快速发展正深刻地影响着信息的传播方式,相伴而来的大量版权侵权行为往往披着"技术中立"的外衣更具迷惑性。对比技术中立原则的域外立法实践,我国在信息网络传播权保护领域适用技术中立原则存在着诸多局限,如认定侵权标准单一、帮助侵权的责任未细分、替代责任未规定、利益与负担不均衡等问题。应当明确技术中立原则适用的指导思想,不断完善侵权责任认定规则,平衡因网络技术发展而引发的互联网领域的利益冲突。

With the development of Internet technology and fast advancement of the network transmission a new way of tort sugarcoated in ＂technology neutrality＂ arises. By comparing the principle of technology neutrality around the world, the principle of technology neutrality apply in the protection of information transmission right which has some weakness. For example, there is a single standard to identify the infringement, responsibility of helping tort does not subdivide, vicari- ous liability is not fixed, interest and burden is unbalanced. Based on the research described above, this article presents the author＇ s own viewpoint and advice on the consummate of the protection of information network dissemination right. In order to solve the problems, we should point out the application on the principle of technology neutrality and clear the tort liability of technology neutrality.
