再论党内法规与国家法律间的关系

Another Discussion on the Relations between Party Regulations and National Laws

党内法规是规范党组织、党员关系的一系列制度规范的总称,国家法律是调整公民之间以及各种社会关系的法律规范制度的总称,二者在国家治理体系与治理能力现代化建设中都在发挥着非常重要的作用。因而,一方面,需要完善党内法规体系建设,让党内法规真正成为管党治党的重要依据,成为党廉政建设的有力保障;另一方面,中国特色社会主义法治体系是包含党内法规在内的各领域规范的一个有机整体,党内法规与国家法律间既有区别,也有一致性,所以,党内法规体系建设需要与国家法律建设相辅相成,依法治国与依规治党需要统筹推进,乃至一体建设。

Party laws and regulations are a general term for a series of institutional norms regulating the rela- tions of Party organizations and between Party members, while national laws are the term for legal norms regulating the various social relations among citizens. Both of them are crucial in building the governance system and capabili- ty of China. Therefore, the paper points out that on the one hand, it is necessary to improve the construction of the intra- Party regulation system to take the intra- Party laws and regulations as guidelines for Party building and its self - governance, and a guarantee for building the Party~ clean administration. On the other hand, the rule of law and rule- based Party self- governance should be fueled simuhaneously in an integrated way, in which the con- struction of intra - Party legal system mutually reinforces with that of national laws, because the socialist system of laws with Chinese characteristics is an organized whole that covers the norms in various fields with both the consis- tency and difference between intra- Party regulations and national laws.
