完善夫妻财产制度的若干建议

Proposals for Improvement of Marital Property System

随着夫妻家庭财产的快速增长和个人财产权利意识的日益加强,我国的夫妻财产关系已经进入新阶段,原来的夫妻财产制度不能完全适应新形势的要求,迫切需要修改和完善夫妻财产制度。为此,有必要结合学术界的争议与司法界的问题,分析我国现行夫妻财产制度和具体规定存在的缺陷,提出构建夫妻法定财产、约定财产等夫妻财产制度的基本体系,并分别就夫妻共有财产的表述和范围、婚后财产权的性质、知识产权的期待利益、婚前财产的增值、继承或受赠所得财产的性质、夫妻财产约定的形式和内容、个人债务的举证责任、夫妻财产的管理权、夫妻忠诚协议的效力等热点问题进行深入的研究。

Along with the quick increase of marital and family property, as well as the enhancement of awareness of individual property, the Chinese marital property relationship has stepped into a new epoch. The previous marital property system could not adapt to the new development in the new circumstances, thus the improvement of relevant systems is in urgent need. The paper which combines the academic disputes and the judicial problems, attempts to analyze the defectiveness in current Chinese marital property system and specific provisions. Furthermore, the paper proposes to establish the basic marital property system of legal marital property and contractual property.
