互联网时代知识产权面临的难题与对策

Difficulties and Countermeasures of Intellectual Property Right in the Internet Age

国际互联网的迅猛发展给传统的知识产权体系带来了巨大冲击,知识产权客体的特殊性使得与知识产权有关的法律问题在网络环境下表现得格外突出。本文主要结合我国目前网络环境下知识产权领域出现的侵权问题,分析知识产权保护遇到的主要难题,针对网络知识产权侵权的内在规律和特点,提出构建法律、技术和道德"三位一体"的对策,实现对网络知识产权的有效保护。

The rapid development of the Internet to the traditional intellectual property system has brought the huge impact,the particularity of intellectual property makes the legal issues related to intellectual property rights in the network environment was especially prominent. This paper mainly with the infringement problems of intellectual property rights in our country under the network environment,analysis of the main problems encountered in the protection of intellectual property rights,according to the internal rules and characteristics of network infringement of intellectual property rights,construct legal,technical and moral ＂three-in-one＂ measures to realize the protection of intellectual property rights.
