间接正犯理论一般承认"利用他人合法行为"的间接正犯类型。然而,根据支配理论的基本观点,在利用他人合法防卫行为的间接正犯类型中,行为人并未完全对防卫人形成犯罪事实上的支配关系;利用行为的非法性与防卫行为的合法性也不具有等价性,传统观点对行为人实行行为未从法益侵害事实角度进行合理、完整的不法分析;从法哲学的角度讲,合法行为无法产生不法后果。应当重新审视"利用他人合法行为"的定性问题。
