论“特别法优于一般法”与《标准化法》的修改

“The Special Law Should be Adopted Before the Common Law”and Amendment of The Standardization Law

"特别法优于一般法"规则作为学理基础为解决法律冲突提供思路,亦即"特别法优先规则"能够应用并应该适用于《标准化法》的修改。针对我国《标准化法》和其他法律的冲突,《深化标准化工作改革方案》通过"统一和例外"的规定为其提供灵活的处理方式。《标准化法(修订草案征求意见稿)》中需要对"特别法优于一般法"的规则进行完善,将特别规定的范围进行扩展。在《标准化法(修订草案征求意见稿)》的附则之中应加入如下条文:"其他法律对标准的内容或标准化的活动另有不同规定的,依照其规定执行。"

We think＂ the special law should be adopted before the common law＂ can be applied to The Standardization law. It can provide new ideas to solve conflicts in the application of law. As to the conflict between The Standardization law and other laws, The Reform Program of Deepen the Standardization Work provides for uniform system and exceptions. This is a flexible approach. The Standardization Law needs to improve＂ The Special Law Should be Adopted Before the Common Law＂. Process needs to be extended. Finally, this article proposes consummate suggestion. Item is if the other law has different stipulations concerning on the contents of the standard and the activities of standardization, those stipulations shall be applied.
