On Law Enforcement Thinking in Public Security

公安执法思维是公安特有的思维方式,一般是指根据社会主义法治理念的精神和要求,公安机关及民警运用法律规则对执法办案实践中遇到的各领域复杂问题进行识别、分析、判断、处理,准确适用法律的思维方式。公安执法思维是法治思维在公安机关执法办案活动中的具体体现,是法治思维在公安执法过程中的具体运用和表现。公安执法思维是一个尚在研究中无权威定论的概念,还存在不少的难点和问题。正因如此,本文以法治思维为基础和前提,结合典型案例,剖析公安执法思维的概念与内涵,揭示良好的公安执法思维的重要性和紧迫性,以期更好地提升公安机关的法治化水平,树立国家法治文明程度和政府的法治形象。

Rule - of - law thought is a legal norms - based logic and rational way of thinking, which is acquired through the absorption of the requirements of modern rule of law and which can be used to understand, analyze and handle legal problems. And it is the premise and foundation of the construction of public security and law enforcement standardization by law. Law en- forcement thinking of public security is a new concept with many difficulties and problems to be addressed. Combined with a typ- ical case and based on the rule - of - law thinking, this paper analyzes the concept and connotation of public security law en- forcement thinking, and discusses the necessity and urgency to cultivate such a pattern of thinking. In so doing, the level of rule of law of the public security organs can be enhanced, andthe law civilization of the country and the legal image of the government improved.
