当前我国社会道德法律化的必要性、可能性与方向性分析

An Analysis of the Necessity,Possibility and Direction of the Legalization of Social Morality in China

在当前我国社会转型期,某些社会问题无法仅仅依靠道德规范来解决,亟须将某些软约束的道德规范上升至具有强制性普遍约束力的法律层面即道德法律化,以此来解决社会问题、稳定社会秩序。道德法律化必不可少的基础和前提是,需要对道德与法律之间的关系具备合理性认识,一个社会中的道德与法律之间既有区别又有联系,我国传统伦理法中蕴藏了丰富的道德教化资源,道德法律化具备了理论和现实上的可能性。在道德法律化的进程中,需要重视道德之于法律的内蕴及拱卫作用,应以法律道德化作为道德法律化的依托和向度,充分发挥法律和道德二者间的相互支撑作用,避免单一道德法律化路径可能产生的弊端和问题。

In the current period of social transformation in China, some social problems cannot be solved by moral normsalone. It is necessary to legalize some soft constraints to achieve stable social order. The basis and premise of the legaliza-tion of morality is to have a reasonable understanding of the dialectical relationship between morality and law in a society,which are not totally distinct from each other. With his utilitarianism, Bentham made valuable legislative attempts. Mon-tesquieu also pointed out that morality and law support each other. China＇s traditional ethics and law contain rich resourcesof moral education. Therefore, the legalization of morality is both theoretically and practically possible in our country. Inthe process of the legalization of morality, we need to pay attention to the moral connotation and to protect the function oflaw. The legalization should be based on the moralization of laws, and they should give full play to each other, support therole of each other, and avoid the disadvantages and problems of one-sided legalization of morality.
