摘要
1979-1991年是中国企业劳动关系转型的起步时期。虽然国家尚未明确市场化改革的导向,但一系列的改革措施却显露出市场化的理念和趋势,表现在劳动关系转型方面:国营企业在劳动关系确立和管理中的权限不断增大,传统的行政性劳动关系出现松动;企业和劳动者的利益诉求开始分化,具有市场经济属性的劳动关系双方利益主体逐渐形成,特别是非国营企业市场化劳动关系的孕育和发展,给国营企业劳动制度改革提供了动力和参照;劳动关系的缔结和管理日趋复杂化,并具有二元化和过渡性的特点,劳动关系法制化建设亟待加强。
The period from 1979 to 1991 was the beginning of the transformation of labor relations in Chinese enterprises. Although the coiintry had not made the market-oriented reform clear y e t, a series of reform measures had revealed the concept and trend of the market-oriented reform, which were in the transformation of labor relations. Firstly, the authority of state-owned enterprises in the establishment and management of labor relations was in an increasing trend, and the traditional administrative labor relations became loose. Secondly, the interests of enterprises and workers began to differentiate, these two main interest subjects with the characteristics of the market economy had gradually formed. In particular, the gestation and development of the market-oriented labor relations in the non-state owned enterprises provided the power and reference for the labor system reform of state-owned enterprises. Thirdly, the comection and management of labor relations were more and more complicated, dualistic and transitional, it means that the legal system construction of labor relations was urgent to be strengthen.
