摘要
资本主义生产力的不断提高,劳动法也在不断的发展。每一次的立法进步皆深深地植根于社会经济发展进程,每一次的立法进步都是因资本升级而需要对劳动关系进行调整。笔者认为我国的现实选择是继续推行"希克斯标准"进行劳动保护的立法、执法工作,而"帕累托最优"只能作为我们今后为之努力的奋斗目标,在今后很长的一段时间内我国将不断进行城乡、地域与产业结构的调整,"十三五规划"也明确提出了"推动区域协调发展,推动城乡协调发展。"等到未来某一时期,行业与地域结构调整到位,以"帕累托最优"方式来保护劳动者权益就会是水到渠成的一件事。
Capitalism rising productivity, labor law also in constant development. Every time the legislative progress is deeply rooted in social and economic development, every progress of the legislation is necessary to adjust labor relations due to capital to upgrade. The author thinks that our country＇s realistic choice is to continue to implement ＂hicks standard＂ in labor protection legislation, law enforcement, and the ＂praetor optimality＂ only as we work on goals in the future, in a very long time in the future China will continuously for the urban and rural, regional and industrial structure adjustment, ＂much starker choices-and graver consequences-in planning＂ also explicitly proposed ＂promote balanced development among regions, and promote the coordinated development of urban and rural areas. ＂Wait for a period in the future, industry and regional structure adjustment in place, in the ＂praetor optimality＂ way to protect the rights and interests of laborers will follow one of the things.
