摘要
现行版权合理使用制度对慕课教育呈现出不适应的状况。慕课的商业化运行机制与合理使用理念相悖,使得慕课对版权的利用面临着较高的法律风险。然而,慕课具有继续适用版权合理使用制度的正当性,创新立法思路与方法包括:正确区分慕课营利与收费的关系、完善合理使用制度的立法技术、制定慕课版权合理使用的规则、建立详细的慕课版权政策指引、赋予合理使用制度强行法属性等。
The current fair use system of copyright presents a state of being not adaptable to the MOOCs education. The commercial operation mechanism of MOOCs is contrary to the fair use concept which leads the MOOCs using copyright to face relatively high legal risks. However,MOOCs has legitimacy to continue to apply to the fair use system of copyright, and the ideas and methods of innovation legislation include correctly distinguishing the relation between MOOCs profit and charge, improving the legislation technology of fair use system,making the fair use rules of MOOCs copyright, establishing detailed policy guidelines of MOOCs copyright and giving the fair use system attribute of mandatory law.
