我国“互联网+调解”发展困境及其路径选择

The Dilemma for the Development of China's “Internet Plus Mediation”

作为生产力要素之一,网络信息技术是一种新的生产工具,其在调解中的运用形成了一个新领域——"互联网+调解"。由于融合了互联网和传统调解的理念,"互联网+调解"近年来在我国开始兴起并逐渐推广,形成了独有的模式、理念与特征。在纠纷解决中发挥优势的同时,"互联网+调解"也面临着现实与虚拟之间、推广与使用之间、形式与实质之间的矛盾与困境。在调解全球发展、社会转型、科技进步等多种因素的作用下,我国"互联网+调解"应在解纷渠道、解纷资源、解纷平台、解纷人员、解纷力量等方面实现多元化、职业化、市场化、信息化和国际化发展。

As a key element of productive forces,internet information technology is a new instrument of production. The application of this technology in mediation opens up a new area,which is＂Internet Plus Mediation＂. Because of the combination of internet ideas and traditional mediation ideas,＂Internet Plus Mediation＂has been thriving all over China recently with unique patterns,ideas and features.While effective in solving social disputes,＂Internet plus mediation＂is facing contradictions between reality and virtuality,promotion and use,form and content. Under the influence of factors including global development of mediation,social transformation,scientific and technological progress,China’s ＂Internet Plus Mediation＂should focus on channels,resources,platforms,personnel and forces of dispute resolution to make its development more diversified,specialized,marketized,informatized and internationalized.
