我国专利侵权赔偿制度实施效果及法定赔偿数额影响因素研究

Patent Infringement Compensation System in China: Implementation Effect and Influencing Factors of Compensation Amount

[目的/意义]2015年12月2日,国务院法制办向社会公开的《专利法修订草案(送审稿)》第68条,拟对专利侵权赔偿制度进行重大修改。但是,自2009年10月1日开始实施的专利侵权赔偿制度实施效果如何,一直以来缺乏实证研究。[方法/过程]以北京、上海和广东三地318份专利侵权赔偿判决书为样本,运用统计分析方法,对现行专利侵权赔偿制度的实施效果进行评价,并研究影响法定赔偿数额的主要因素。[结果/结论]研究结果发现:虽然《专利法》第65条的立法目的在司法实践中没有得到完全实现,但是专利质量和案件复杂程度对法定赔偿数额具有显著的积极影响。

[ Purpose/Significance] The 68th article in the ＂ Patent Law Revised Draft （Draft Submitted for Approval）＂ released to the public by the Legislative Affairs Office of the State Council on December 2,2015 presents a major modification to the patent infringement compensation system. However, there always lacks an empirical research on the effectiveness of the implementation of the patent infringe- ment damage compensation system since October 1,2009. [ Method/Process] In this paper,318 court verdicts of patent infringement dama- ges from Beijing, Shanghai and Guangdong are used as a sample in the study of the effect of the current patent infringement damage com- pensation system and the main factors affecting the amount of the compensation of patent infringement through the statistical analysis meth- od. [ Results/Condusion] The results indicate that although the legislation purpose of the 65th article in ＂Patent Law＂ failed to be fully met in the judicial practice,patent quality and case complexity have a significant positive influence on legal compensation amount.
