互助原则是船东互助保赔制度的基本原则,其不仅贯穿和引领船东互助保赔的各项制度,还为船东互助保赔制度的完善提供理论支持。船东互助保赔制度存在法律适用混乱和保险监管缺位等问题。这些问题的解决关键在于遵循互助原则、尊重船东意思自治的产物——会员先付条款,同时在特定情况下兼顾公共利益,例外地允许与之偏离;尊重船东所选择的协会,在普遍对协会进行保险监管的同时,为协会制定与之相适应的监管标准。
