著作权集体管理组织反垄断问题研究

A Study on the Anti-Monopoly Issues concerning Copyright Collective Management Organization

著作权集体管理组织应采取竞争模式还是垄断模式,各国做法不一,学界观点各异。其实,集体管理组织模式的选择取决于一国的国情及相关配套制度的完善程度,就我国当前的现状而言,赋予集体管理组织先天的垄断性容易使其滥用垄断权,给著作权人和作品使用者的利益造成损害。而要从根本上消除垄断,必须从源头上引入竞争机制,允许一类作品建立多个集体管理组织;同时必须完善监督手段和监督程序,明确集体管理组织的义务和责任,以便消除市场竞争形成的事实垄断。

The copyright collective management organization should adopt competition mode or monopoly mode, the practice varies in different countries, and the academic viewpoints are different. In fact, the choice of the collective management organization mode is up to a country＇s national situation and the maturity of relevant supporting systems. For the time being, to give collective management organization with innate monopoly power may lead to abusive use of power, and impairs the interests of copyright owner and the user of works. In order to fundamentally eliminate monopoly,the competitive mechanism should be introduced, allowing a class of works to be administered by a number of collective management organizations; meanwhile, to eliminate de facto monopoly result from market competition. It is suggested to improve the supervisory means and procedures, and define the obligations and responsibilities of the collective management organization.
