摘要
食品生产经营者的败德行为和消费者的不当饮食行为是引发食品安全问题的原因。食品安全信息强制公开制度因食品有毒有害物质含量等食品安全信息的生产成本较高,不是抑制食品生产经营者败德行为的最佳工具。但其可以通过向消费者传递食品中的营养成分信息等食品安全信息,以便消费者选择健康饮食,预防因消费者不当饮食行为引发的食品安全问题。在向消费者传递食品安全信息方面,我国食品安全信息强制公开制度尚存不足需要完善。因为消费者健康饮食责任意识和食品安全知识缺乏,目前我国食品安全信息强制公开制度未能充分发挥其指引消费者健康饮食决策的功能。为此,应通过立法培养消费者健康饮食责任意识,并完善我国食品安全教育制度。
The food production operators' immoral behaviors caused by information asymmetry and the consumers' unreasonable dietary behaviors lead to food safety problems. Mandatory disclosure of food safety information is not the optimal instrument in regulating food production operators' immoral behaviors, for the high costs of producing the information about food poisonous and harmful factors. But it could lead consumers to eat healthily by passing them the food safety information about nutritional ingredient etc, so that the food safety problems caused by the consumers' unreasonable dietary behaviors could be prevented. In passing food safety information on to consumers, the current mandatory disclosure system of food safety information in Chinese food safety law is imperfect, so it should be improved. At present, the mandatory disclosure system of food safety information in Chinese food safety law could not achieve the goal of leading consumers to eat healthily, for the consumers' lack of awareness of eating healthily and food safety knowledge. Therefore, it is necessary to build consumers awareness of eating healthily by legislation, and to perfect the food safety education system.
