摘要
《刑法》第37条关于定罪免刑的规定是一个具有丰富价值内涵的制度设计。加强对该条中定罪免刑制度的研究,对于彰显刑法谦抑、实现刑罚目的、畅通刑罚机制以及创新社会管理都具有非同寻常的价值和意义。
The conviction pardon is a system which has rich connotation. Taking the article 37 seriously and strengthening re-search on the conviction pardon system have great value in revealing the austerity of criminal law, implementing the penalty purpose, smoothing punishment mechanism and innovating social management.
