对我国特赦制度现状的思考

On Current Situation of China's Special Pardon System

现代特赦制度具有保障人权、调解矛盾、维护国家稳定的功效,当今世界,特赦制度在绝大多数法治构建比较完备的国家都有明文规定。应对我国特赦制度发展的现状进行思考,以对我国特赦制度的完善建言建策。

Special pardon system is a flexible system. It can make up for a lack of criminal law to maintain social stability and ease social contradictions. Ancient pardon system mostly revealed imperial grace, was a means of imperial majesty. But with the devel-opment ,the modern special pardon system can protect the criminals ’ human right, mediate the contradiction between the various groups, and maintain social stability. In most developed countries has amnesty system under the rule of law. This paper analyzes the current situation of China,s special pardon system with purpose of contributing to its development and improvement.
