摘要
案件质量管理是最高人民法院及地方各级人民法院针对我国司法实践中较为突出的案件质量偏差以及司法公信力日益降低等现实问题所作的回应。然而由于我国现行案件质量管理组织机构及其运行程序极端科层化,原本以重拾司法规律、凸显裁判权威以及克服法院内部行政化之名而进行的审判管理改革,最后竟以强行政化而告终。结果是理应具有独立地位及自主判断权的法官被整合进层层权力之网,深陷重重监督和考核难以自拔。为了实现案件质量管理提升案件质量、增进司法公正、规范司法活动的初始目标,亟需对其予以进一步调整和完善。
The case quality management is a response of the Supreme People 's Court and people 's courts at various local levels to the real problem coming from the low overall case quality and the judicial credibility. However,the current case quality management has been gradually alienated to a restrictive institution which distorts the judicial activities and deviates from the law of judicial because of its extremely bureaucratization and administration. In order to achieve the original aims of improving the case quality,promoting impartial justice and standardizing the judicial activities,case quality management should be further adjusted.
