论刑事侦查的监督——以防范冤假错案为视角

On the Supervision of Criminal Investigation:From the Perspective of Preventing Miscarriage

侦查阶段是我国冤假错案的多发阶段,非法行使侦查权不仅影响法治进程,更重要的是侵犯犯罪嫌疑人基本人权;侦查权不当行使的根源在于侦查机关自由裁量权过大、刑事侦查监督不力、司法理念错误等。从尊重和保障人权、遵循正当程序、更新司法理念角度入手,增强侦查机关自我监督、辩护人及诉讼参与人、新闻媒体、社会公众对刑事侦查的监督,形成良好的刑事侦查监督氛围,实现保障人权与惩罚犯罪的最终目的。

The miscarriage tend to occur in investigation stage in our country . The illegal investigation pow-er performing not only influences the legal process , but also violates the basic human rights of the suspect. Its root cause lies in the power of the investigation organ being too large , the lack of supervision,the judi-cial concept errors and so on. Therefore,from the perspective of respect for and protection of human rights,following due process and updating the concept of justice , it is needed to strengthen the investiga -tive authorities , self-supervision,the supervision of criminal investigation by the defender , litigation par-ticipants , news media,as well as the public,in order to form a good criminal investigation and supervision environment, and realize the ultimate aim of safeguarding human rights and punishing crimes .
