摘要
《中华人民共和国刑法》第143条生产、销售不符合安全标准的食品罪在防范食品安全犯罪中起到重要作用。在国家向风险社会过渡的特殊时期,中国更应恪守传统刑法的罪责主义,坚决维护将其认定为经济犯罪的性质取向,严格根据罪行法定原则指导司法实践,否定风险刑法在食品安全犯罪中的适用。
The article 143 of the Cr iminal Law of the People's Republic of China defines the food safety crime of production and sale of food without meeting the safety standards , which plays an important role in preventing food safety crimes . In the special period of transition to the risky society , we should abide by the guilt doctrine of traditional criminal law,and resolutely maintain the nature of its economic crime ori-entation ,strictly guide the judicial practice according to the principle of legality ,and negate the risk of criminal law in the application of food safety crime .
