摘要
随着中国—东盟自由贸易区快速发展,中国和东盟各国之间不可避免地出现了一些经贸争端。对于这些争端,中国和东盟各国已构建了一套多途径争端解决机制,包括调解、仲裁、诉讼等。但是从经贸争端解决的实践来看,诉讼方式仍然没有被大多数当事人采用,原因之一在于中国涉东盟纠纷诉讼解决法律人才方面的严重短缺。目前,中国涉东盟诉讼纠纷解决的法律人才培养存在着高校的法学教育落后、在职培训不足的困境。要采取改变中国高校的法学教育培养方案,明确定位人才培养目标是培养复合型人才,合理设置教学课程和编制教材,提升高校教师团队水平,加强在职法律人才的培训等方式来突破中国涉东盟诉讼纠纷解决的法律人才培养困境。
With the speedy development of China-ASEAN free trade area, trade disputes inevitably arise between China and other members of ASEAN. As to these disputes, China and other members of ASEAN have built a multi-approach to dispute settlement mechanism, including mediation, arbitration and litigation. But from the practice of trade dispute settlement, the manner of litigation still has not been adopted by the two parties. It is because that China is lack of enough legal talents who can settle the dispute litigation involving ASEAN. It is imperative that China cultivate a large number of legal talents who can settle the disputes involving ASEAN. At present, the cultivation of legal talents settling the disputes involving ASEAN has such problems, backward of legal education in Chinese higher institutions, not enough in-service training. To solve these problems, China should properly set up curriculum course, compile appropriate teaching material, improve teacher's teaching performance and strengthen the in-service training of the legal talents.
