随着新主观预防理念兴起而确立的性犯罪记录制度,是域外性犯罪再犯的主要预防机制。基于性犯罪特殊成因和我国近10年性犯罪再犯数据统计,我国引入性犯罪记录制度确有必要,但当前的本土化尝试,却过度关注信息公开规则,忽视了作为性犯罪记录制度基本要素的登记申报规则和权利资格限制规则。而我国未来性犯罪记录建构的合理路径,应当以基本要素规则的本土化为主要方向,并使其成为我国宏观国家犯罪记录体系的重要一环。
