我国村民自主决策中多数决制度的运用及完善

On the Improvement of the Majority Decision System in the Villagers' Autonomous Decision in China

根据《宪法》以及《村民委员会组织法》的相关规定,村民享有四项基本的自治权,即民主选举、民主决策、民主管理与民主监督。多数决制度在村民自治权中均有体现,尤其在民主决策环节。民主决策是村民自治的重要内容,村民自治权在很大程度上是通过民主决策的形式来实现的。然而,多数决制度存在诸多缺陷,不当运用很容易侵犯少部分村民的利益。因此,在村民自主决策过程中,应通过更好地确定参会人员范围、完善村民决策程序机制以及少数人的权利救治制度来进一步完善多数决制度。

According to the constitution and the villagers committee, the relevant provisions of the villagers has four basic autonomy, namely the democratic elections, democratic policy-making, democratic management and democratic supervision. Majority system are re-flected in the villagers autonomy, especially in the democratic decision-making. Democratic decision-making is an important content of self-governance among villagers, the villagers autonomy in the very great degree is realized through the form of democratic decision-mak-ing. Majority system has many defects, however, the improper use is easy to infringe the interests of the few villagers. There fore, in the process of villagers＇autonomous decision-making, we should further improve the majority decision system by better defining the scope of the participants, improving the decision-making me chanism of the villagers and the relief system of minority rights.
