摘要
通过分析小区违建对社会公平、法治社会建设、邻里关系和建筑安全的危害,以及与现今法律法规不健全、城管授权不明确、物业缺乏执行能力及意愿和居民自主治理不具约束力的治理困境,根据奥斯特罗姆的公共组织理论,运用公共权力与私人体制相结合的方法,提出应该从明确界定居民空间权利的角度完善相关法律法规、加强城管行政职能和提高行政效率、授予物业行政权力和鼓励居民自主治理、加强监督等治理对策。
Through the damage of the residential illegal construction to the social equality, the rule of law society construction, neighborly relations and construction risk, And the governance dilemma that current laws and regulations are not sound, city management authoriza- tion is not clear, tenement lacks the ability and wish to execute and resident of autonomous governance is not binding, according to Ostrom's public organization theory, using the way of public power with private system, put forward the countermeasures that we should clear the definition of resident space right from the angle of completing the relevant laws and regulations, strengthen the city management' s adminis- trative functions and improve the administrative efficiency, award the tenement administrative power and encourage resident' s autonomous governance, strengthen the supervision.
