摘要
行政处罚应该是一种以惩戒制裁为手段,以矫正教育为目的的行政行为,然而目前我国的行政处罚制度存在着一些不合理的地方。论文以杭州市方林富炒货店违反新广告法事件为案例进行分析,总结由于当前行政处罚价值取向不合理、行政审查制度不健全造成行政处罚行为不公平以及行政自由裁量权运用不足造成的行政处罚行为、内容不客观不适度等三方面问题,并给出了相应的建议和对策,包括坚持矫正教育为主的价值取向、制定严格的行政审查制度、合理运用行政处罚中的自由裁量权。
Administrative punishment should be a kind of administrative action that treats the punish sanctions as a method and correct education as the purpose .However, at present, there are some unreasonable places in our country's administrative punishment system. The paper takes Hangzhou Fanglinfu food store has violated the new advertisement law as an example, and summarizes the problems from three aspects: the unreasonable value orientation of administrative penalty, imperfect administrative review system caused the administrative punishment not fair, and the lack using of administrative discretion caused the unfair administrative punishment and the moderate content. Some corresponding recommendations and countermeasures are given, such as the value orientation of sticking to give priority to the correctional education, a strict system of administrative review and the rational use of discretion in administrative penalty.
