县乡两级社区矫正工作权责状况研究

合法性危机与权责失衡是基层社区矫正工作面临的两大难题。县乡两级社区矫正机构在审前评估、交付接收、刑罚执行、收监执行等环节存在"权力有限、责任无限"。产生这一境况的原因在于社区矫正机构刑事强制权的缺失、机构及队伍力量不足、规范性文件与部门规章冲突。县乡两级社区矫正工作权责一致需要解决好社区矫正执法警察身份这一重大而敏感问题,需要明晰县乡两级社区矫正机构的责任,并建立责任追究机制。

The legitimation crisis and the unbalance in rights and liabilities are two major problems that grass -roots community correction work is facing. ＂Limited power, unlimited liability＂ exist in county and township community correction agencies in the pre - trial assessment, delivery, the implementation of penal- ties, the implementation of supervision and other aspects. The reason for this situation is the lack of criminal enforcement of community corrections, the lack of institutional and team strength, normative documents and departmental regulations conflict. The community correction in county and township need to solve the impor- tant and sensitive issue of community correction law enforcement police identity, clarify their responsibili- ties, and establish the accountability mechanisms.
