国际体育法基本理论研究述评

Review of the Foundmental Theory of International Sports Law

从国际体育法理论研究的缘起及学术进展、国际体育法概念和国际体育法的渊源三个方面对国内外现有的研究成果进行梳理与评述。结论：国际体育法的理论研究呈现蓬勃发展的趋势;学者们创设了不同术语阐释国际体育法的概念,着眼于国际体育法的独特性,但目前尚未形成一致的见解;关于国际体育渊源的研究,国外学者的研究着重于体现国际体育法独特的自治性和自我生成性,但尚缺乏系统的法理支撑。国内学者的研究更多的以传统的国际法理论为基础,但缺乏对国际体育法独特性的阐释。目前存在传统国际法理论研究范式和体育自治法研究范式,但远未形成系统理论研究体系,留有巨大的学术研究空间。应构建兼顾传统法理和体育法自治性的国际体育法理论体系。

This essay combs and reviews tile existing research achievements at home and abroad fl＇om three as- peels, which include the origin and academic development of theoretical research on international sports law, the concept of international sports law, and the legal sources of international sports law. The theoretical research of international sports law has risen and flourished. Scholars have created different terms to explain the concept of international sports law focusing on the uniqueness of international sports law. However, no consensus about the concept has been reached. On the research of legal sources of international sports law, fbreign scholars focus on the unique autonomy and self-generating, but it lacks systematic legal support. Domestic scholars focus on the traditional theory of international law, but it lacks interpretation of the uniqueness of international sports law. There exists two kinds of research paradigms, including traditional international law research paradigm and sports autonomy law, research paradigm. However, the formation of system theo~ research system is still far behind. Theretorc, there is a huge academic research space. The theoretical system of international sports law takes into account the traditional jurisprudence and the autonomy of sports law should be constructed.
