发明专利创造性审查中技术问题及技术效果的判断

The Analysis of Technical Problem and Technical Effect in Inventive Step Judgement of Patent Examination

"三性评判为主线"是我国专利审查的基本要求,技术问题和技术效果的确定对创造性审查中:最接近现有技术的选取是否准确、发明实际解决技术问题的确定是否正确、以及现有技术是否存在结合启示都起到关键性的作用,其直接关系到案件走向的正确与否,本文以《专利审查指南(2010)》为基础,对创造性审查中涉及到的技术问题和技术效果的判断做出解析,并结合实际案例进一步进行探讨,希望对相关主体有所帮助。

Inventive step is one of the essential requirements to be satisfied for an invention to be granted a patent right in china.Technical problem and technical effect are the key factors to judge if the invention have overcome the defects and deficiencies in existing technology, and the technical problem actually solved by the invention, whether or not the invention produce advantageous technical effect and whether or not there exist such technical motivation in the prior art are very important to determine if the invention has prominent substantive features and represents notable progress in Inventive step examination. Here, we will discuss how to analyze and consider the technical problem and technical effect in inventive step examination according to GUIDELINES FOR PATENT EXAMINATION （2010） of china, and we will give examples of assessment to study.Hope it will be helpful to somebodies.
