Preliminary Discussion on Examination of Patent Eligibility in the United States

本文从法定分类、司法例外、司法例外是否属于特定应用、涉及自然法则的适格性判断等几个方面,系统介绍了美国专利审查指南关于适格性的相关规定,并结合案例对适格性的判断思路和流程进行了示例性说明,对从事美国专利申请的从业人员具有较强的实际指导意义。

This article introduces the provisions about eligibility in MPEP, from several aspects of the four categories of statutory subject matter, judicial exception to the four categories, the practical application of judicial exception, and the determination of laws of nature.Further, some cases are provided to explain the consideration and process of eligibility.It is a helpful guidance for the patent practitioner, who works on patent application of the United States, in China.
