Why Formal Justice?——On Rawls' Choice of the Road to Justice

罗尔斯正义理论具有极其强烈的实质正义诉求,而其最鲜明特征却是其在实现这一诉求时对形式正义进路的选择。本文试图借助罗尔斯《正义论》对形式正义的描述,概括出形式正义的基本要素,通过他对正义实践中选择形式正义进路之诸种原因的分析与解读,获得对"形式正义"的概念更为准确的理解,呈现出对这一进路更为全面的把握,从而解答"为什么是形式正义才是罗尔斯通往正义之途的进路选择"这一问题。

Rawls＇ theory of justice has an extremely strong appeal to the substantive justice, while its most distinctive fea- ture is the road of formal justice what he choose to realize this appeal. This paper attempts to summarize the basic elements of formal justice by analyzing the description of formal justice in a theory of justice, and through analyzing and interpreting the reasons why Rawls choose formal justice in the practice of justice, we could obtain a more accurate understanding of the concept of ＂formal justice＂, holding a more comprehensive grasp of this road, and offering an answer of the question ＂why Rawls choose this road to realize his idea＂.
