论打击大气污染犯罪的瓶颈及对策

The Bottleneck to Crack Down on The Crime of Atmospheric Pollution and the Countermeasures

大气污染问题现阶段已经严重的影响人们的生活,由于大气的自然属性,使得打击大气污染犯罪成为一个棘手的难题。虽然大气污染问题严峻,但是我国在治理大气污染以及打击大气污染犯罪方面已经做出了许多的努力。不过在打击大气污染犯罪方面,还存在着一些瓶颈,例如大气污染犯罪未能单独立罪;大气监察难度大;受利群体人为阻挠;打击犯罪的起诉过程受阻严重等。针对打击大气污染犯罪遇到的瓶颈进行分析研究,试图解决大气污染犯罪打击过程中的难题,提出解决打击瓶颈的具体对策,促进大气污染整治。

Atmospheric pollution problem has seriously affected the life of people at present stage. Due to the nature of the atmosphere, made to crack down on the crime of atmospheric pollution become a thorny problem. Although the problem of atmospheric pollution is serious,China has made a lot of effort in tackling air pollution and combating air pollution. But there are some bottlenecks, in the fight against air pollution crime, such as air pollution to single independent crime; atmospheric monitoring is difficult; the beneficiary group was obstructed; severe crime prosecution process is blocked, etc. To fight against air pollution crime encountered bottleneck analysis, trying to solve the crime against the problems in the process of atmospheric pollution, this article puts forward the concrete countermeasures against bottleneck and promotes atmospheric pollution treatment.
