近年来,国内发生了多起药品安全事故,严重损害了人民群众的生命财产权益。造成上述事故的主要原因在于目前我国药品市场监管存在的不作为现象。结合药品本身的特殊性质,剖析我国药品市场监管问题产生的根源,强调对监管主体在行政执法中不作为现象采取法治应对的必要性,并提出具体法治应对措施。

In recent years, many drug safety accidents have seriously damaged the people＇ s life and property rights and interests in China. By analyzing the current phenomenon of the inaction of the supervision on drug mar- ket in China and combining with the special nature of the drug, the paper further analyzes the root causes of the supervision problems in the drug market in China, and emphasizes the necessity of taking the rule of law to the in- action of the subject in administrative law enforcement, and puts forward specific measures to cope with the prob- lems by the rule of law.
