Empirical analysis of social investigation system of juvenile criminal cases——Taking the social survey system of Q Municipal People's Court as a sample

未成年人刑事案件社会调查制度在2012年修订的刑事诉讼法中得以正式确立,凸显了对未成年人特殊保护的价值蕴含。但基于未成年人刑事案件社会调查制度的立法缺乏强制性、明确性、可操作性等因素,实践中存在适用率不高、适用对象不平等、主体不明确等问题。通过实证研究的方法,针对突出问题进行剖析研究,提出相应的改进措施,以期对完善社会调查制度的立法、改进相关工作机制有所裨益。

The social investigation system of juvenile criminal cases was formally established in the revised Crim- inal Procedure Law in 2012 ,which highlighted the value implication of special protection for minors. However, the legislation based on the social investigation system of juvenile criminal cases lacks the mandatory, clear and operable factors, such as the low application rate, the unequal objects, the unclear subjects and so on. The article uses the method of empirical research, analyzes the outstanding problems and puts forward the corresponding im- provement measures, so as to improve the legislation of the social investigation system and improve the relevant working mechanism.
