我国非法野生动物交易法律规制研究

Study on legal regulation of illegal wildlife transactions in China

野生动物是生态系统中至关重要的组成部分。野生动物保护是当今社会面临的重要挑战之一,野生动物交易的法律规制可以为野生动物保护提供重要的制度保障。我国现阶段加入的国际公约、野生动物保护的法律法规、野生动物资源的所有权制度与管理体制的局限性,成为非法野生动物交易有效规制的障碍。完善野生动物交易规制,需要借鉴外国的有益经验,从扩大野生动物界定的范围、明确野生动物资源所有权、协调野生动物交易管制主体、加强预防措施、加快动物福利立法的角度进行系统改进。

Wildlife is a vital part of the ecosystem. Wildlife protection is one of the important challenges faced by the society today. The legal regulation of wildlife transactions can provide important system guarantee for wildlife protection. The international conventions, the laws and regulations of wildlife protection, the ownership system of wildlife resources and the limitation of management system have become obstacles to the effective regulation of illegal wildlife transactions. To improve the regulation of wildlife transaction, we need to learn from the beneficial experience of foreign countries to improve the system from the perspective of expanding the definition of wild- life, clarifying the rights of wildlife resources, coordinating the main body of controlling the wildlife transactions, strengthening preventive measures and speeding up animal welfare legislation.
