关于窃用支付宝账号并转移资金行为的性质探究

随着网络电子经济的不断发展,经济交易方式呈现出了新的特点与需求,支付宝为网上购物用户提供了安全、快捷、保障的支付交易方式,但同时出现的安全漏洞问题不容忽视。而本文就关于窃用支付宝账号并转移资金这一行为的定性进行探讨,到底是定性为诈骗罪还是信用卡诈骗罪还是盗窃罪,我们着眼于几个重点问题:支付宝的定性问题,支付宝是否成为诈骗罪的对象,该案例又是否符合三角诈骗的情形以及支付宝是否存在着认知能力。本文认为支付宝在一定程度可以成为诈骗罪的对象,但就本案该种情形而言,支付宝不是诈骗罪的对象,且支付宝不存在认知能力,即无正确认识和错误认识之说。笔者认为窃用支付宝账号并转移资金行为不能一概而论,当资金是从支付宝余额里面窃取时应当认定为盗窃罪;而当资金是从支付宝所绑定的银行卡里转移的则应当认定为信用卡诈骗罪。

New transitions are making their appearance as a result of rapid development of network-and electronics-driven economy. Alipay is so convenient an e-based payment and is gaining such a big popularity that is has become one of the leaders in this respect in China. However, security problem cannot be neglected. The present study endeavors to define the misconduct of stealing others' Alipay account and transferring funds in it. The study elaborates four questions:(1) what is the nature of Alipay?(2) Can Alipay be the object of a fraud?(3) Is Alipay capable of understanding?(4)It is a case of tri-party fraud? Thestudy argues that although Alipay can be the object of cheating in some sense, it is not capable of cognitive processing, not to mention distinguishing right between wrong. Thus, Alipay is not the object of a fraud. The study then proposes that two specific subcategories of this misconduct shall be classified. It is a theft when the residual funds in the account are stolen; and is a credit card cheating when the funds in the debit or credit cards bound in the account are transferred.
