贪污贿赂犯罪二元定罪量刑标准的情节适用问题——基于贪污贿赂犯罪司法解释的分析

《刑法修正案(九)》对贪污贿赂犯罪的定罪量刑标准作出重大修改,引入了数额与情节并重的二元定罪量刑标准。最新的司法解释具体化了这一标准。从规范法学的角度对有关情节的适用加以考查,存在着情节标准中的数额问题、标准竞合下的情节适用问题以及数罪并罚下的情节适用问题等争议问题。对于情节标准中的数额问题,应当坚持罪刑相适应的基本要求,将特定"情节"的数额因素比照"数额"标准加以考量。对于标准竞合下的情节适用问题,应当以数额为基准,并辅以"重法优于轻法"原则加以处理。对于数罪并罚下的情节适用问题,应当贯彻充分评价与禁止重复评价之原则,区分不同情形进行处理。

The amendment(IX) to criminal law makes an important revision of the standards of conviction and sentencing in the crime of corruption and bribery by introducing dual convicting and sentencing standard. The latest judicial interpretations specify this standard. From the perspective of law norms, there are some issues in the application of the plots, including the amounts of the 'plot'standard, the application of plots when the clauses overlap and when the punishments combine for several offenses. For the first issue, we should adhere to principles of convictions and crime adaptability in accordance with the 'amount'standard. For the second issue, we should deal with it on the basis of the amount and supplement according to the principle of'severe law being prior to light law'. For the last issue, we should carry out the principle of full evaluation and prohibition of repeated evaluation and distinguish between different situations.
