在互联网大数据时代,网络虚拟财产与人们的生活联系越来越紧密,各类纠纷也相伴而来。《民法总则》首次将网络虚拟财产纳入民事权利的范畴,引起了学界对网络虚拟财产的广泛关注,而关于在于网络虚拟财产纠纷案件中,举证责任如何分配,这一问题争议很大。因此,首先通过对网络虚拟财产进行概念界定,接着对网络虚拟财产纠纷的主要侵权类型进行介绍,再结合对这种特殊侵权纠纷特性以及影响此种侵权纠纷举证责任分配因素的分析,最后从用户和运营服务商各自承担的举证责任为切入点,对完善网络虚拟财产纠纷举证责任分配制度提出笔者的建议。

In the era of Internet big data, the network virtual property gets linked with the people's life more closely and all kinds of disputes occur. In General Provisions of Civil Law the first time the network virtual property was put into the scope of civil rights, which has aroused the extensive concern of the academic circles to the network virtual property. And in the case of virtual property disputes, how to allocate the burden of proof is controversial. Therefore, first of all, we should define the concept of network virtual property, and then introduce the main types of infringement of network virtual property disputes. Then combined with the analysis of characters of network virtual property infringement disputes and the factors affecting the distribution of the burden of proof in tort disputes, the authors put forward some suggestions to improve the distribution of the burden of proof in the network virtual property disputes, from the user and operator service providers to bear the burden of proof as the starting point.
