教育部印发的《依法治教实施纲要(2016-2020年)》明确提出,要改革高等教育管理方式,建设现代大学制度。而现代大学的管理制度,无疑是现代法治国家的重要组成部分,这是党的十八届四中全会所明确要求的。通过法治方式管理大学,将现代大学的参与顶层设计、服务重大决策、保障改革发展、应对法律纠纷、推进民主管理和法治教育等职能落到实处,迫切需要高等学校的党员特别是领导干部提升自身的法律素养,能够熟练运用法治思维、采用法治方式对高等学校实施有效治理,真正实现依法治校和依法治教,开辟我国高等教育的新天地。法治思维的提升,是对高等学校的领导干部提出的基本要求,关乎到高等教育的法治进程和社会主义办学方向。从高等学校各项规章制度制定与执行、化解学校发展的阶段性矛盾、维护学校安定和谐的良好秩序、形成健康向上的学术氛围到教书育人等诸方面,高等学校领导要养成办事依法、遇事找法、解决问题用法、化解矛盾靠法的法治思维观念,进而培养广大学生的法律认知,自觉做到知法、懂法、守法、用法。

From the formulation and implementation of various regulations and systems of colleges and universities, the phases of resolving school development contradictions, maintaining the good order of school and harmony, forming a healthy academic atmosphere in the aspects such as teaching, university leaders to develop a method of handle affairs according to law, they will find, solve problems and dissolve the contradiction by law.
