摘要
学界多有主张废除先裁后审制度,但先裁后审的立法理念是值得支持和肯定的,制度施行未达到预期目标原因在于理念法制化过程中的制度构造已经远远不能适应劳动争议处理实践的需要。因此应基于立法理念的合理性维持先裁后审制度,同时通过提高仲裁质量、限制诉讼初始化来完善裁审关系所依赖的仲裁制度和诉讼制度的缺陷和不足,即加强劳动仲裁机构实体化建设、强化劳动仲裁员专业素质、保障当事人意思自治、健全劳动仲裁监督机制以及明确定位裁审关系、重构裁审衔接机制。
Although scholars advocate the abolition of the'arbitration before trial'system,the idea of its legislation is worthy of our support and affirmation.It fails to achieve the desired objectives because its institutional structure can no longer meet the demands of labor dispute settlement.Therefore the system should continue,and we should perfect arbitration and litigation system by improving the arbitration quality and limiting the litigation initialization,exactly speaking,by substantializing labor arbitration organizations,promoting arbitrators’professional quality,protecting the autonomy of the parties’will,improving supervision mechanism,clarifying the position of the trial,and reconstructing the linking mechanism between arbitrations and trials.
