摘要
关于"春晚"在著作权法中的属性,司法实践中各法院判决不一,理论界对此同样存在争议。对我国相关司法实践进行考察,可以总结出三种观点:汇编作品、电影或类似摄制电影方法创作的作品(影视作品)、录像制品。从著作权法各作品的含义以及利益平衡的角度探析,现场"春晚"本质上是由多种节目组成的综合性演出活动,是对不同类型作品表演的汇集,作为表演组织者的央视可以享有表演者权,录制后荧屏上播放的"春晚"属于录像制品,可以获得邻接权保护。
On the property of "Spring Festival Gala" in Copyright Law, judgments vary from court to court, while theorists are equally controversial. To study the relevant judicial practice in our country, it can be summed up three views : compilation of works, movies or similar film production works (film and television works), video products. From the perspective of the meaning of copyright works and the balance of interests, the "Spring Festival Ga- la" is a comprehensive performance activity composed of various programs, and a collection of performances of dif- ferent types of works. So CCTV, as a performer, can enjoy the performer's rights, and the recorded "Spring Festival Gala" belongs to the video products, protected adjacency.
