新《消费者权益保护法》中消费者协会职能的完善建议——以消费公益诉讼第一案为视角 被引量:1

摘要 2013年颁布的《消费者权益保护法》丰富了消费者协会的职能,但是从2014年3月15日实施至今仍然较少细致的规定,导致实践中消费者协会职能的履行缺乏可操作性等问题。以2015年上海消保委提起的全国首起消费公益诉讼为切入点,提出完善消费者协会公益诉讼、消费教育、消费保护等方面职能的建议,以便更好解决消费纠纷,保护消费者的权利。 The "Consumer Protection Law" promulgated in 2013, has greatly enriched the functions of the Consumer Association, but it is still a lack of further explanation to make more detailed provisions for its {unctions, since its implementation from March 15, 2014. This results in the fact that the Consumers As- sociation~ {unctions in the practice performance lack of maneuverability. In 2015, the Shanghai Consumer Protection Committee and the association brought the first consumer public interest litigation as the starting point so as to further improve the Consumer Association's public interest litigation, consumer educa- tion, consumption proteltion to solve the disputes and protect the rights of consumers.
