诉讼法学案例教学法的反思与探索

摘要 案例教学法是英美等国法学教育中一种重要的教学方法。我国的诉讼法学教学中也引入了这一方法,但是目前正面临着这样一种局面:传统的案例教学弊端颇多而亟待改进,现代诊所式教学法正遭遇困境。为弥补前述方法的缺陷,论文提出建构适应我国现阶段诉讼法学教学的"案例研讨+模拟法庭"教学法,供学界同仁批评指正。 The method of case study is an important teaching method in law education of Anglo-American countries. Our country also bring this approach into the teaching of procedure law. But now it is confronted with such a situation:the traditional case-teaching has many drawbacks and need to be improved urgently, and the modem clinical teaching method encounters obstacles. In order to make up for the defect of the preceding method,this paper proposes that the construction of "Case discussion + moot court" teaching method to meet the need of the present teaching of procedure law,in order to ask for advice from bound colleague.
