中国知识产权话语策略研究:基于话语与秩序相互建构的视角

Study on China's Discourse Strategies of Intellectual Property Based on the Interaction between Discourse and International Order of Intellectual Property

话语与知识产权国际保护秩序存在着相互建构的关系:一方面,话语建构知识产权国际立法议题、论证立法的合理性、影响国际规范的内化,从而能动地作用于知识产权国际法律制度的规范生成以及规范遵守;另一方面,秩序有着话语生产、话语框定及意识形态功能,知识产权国际立法形成了话语的基点,规约着话语的规则,在最大限度上决定着"谁有权说并被听到"。基于此,中国宜采取相应的策略推进知识产权话语,加强对知识产权国际保护秩序的影响力。

Mutual influences and interaction exist between discourse and international protection on intellectual property. On the one hand, discourse constructs international legislation subjects for intellectual property, verifies the rationality of legislation, and affects the internalization of international norms, which thereby plays the role in the formulation and compliance with the international legal norms of intellectual property. On the other hand, order functions in the generation and framework of discourse and ideology. The international legislation of intellectual property forms a base point for discourse; meanwhile, the prevailing international protection order of intellectual property determines the fact that who enjoys the right to speak and be heard to the greatest extent. Based on this, China should adopt appropriate strategies to promote intellectual property discourse, and strengthen the influence on the international protection order of intellectual property rights.
