专门管辖不应排斥协议管辖之适用

Special Jurisdiction Should Not Exclude the Application of Agreement Jurisdiction

现行立法关于专门管辖性质和效力定位含糊,司法实务中往往将其与专属管辖同等对待甚至纳入专属管辖的范围,排斥协议管辖的适用。根据专属管辖排斥协议管辖适用乃基于公益性目的之法理,结合我国专门管辖制度的性质特征,即可发现专门管辖并不具备排斥协议管辖适用之正当理由。相关司法解释的规定和司法实务中的做法亟待改正。

Stipulation on the nature of special jurisdiction and its effect in current Civil Procedure Law is not clear. Still, it is common in the judicial practice that special jurisdiction is treated as exclusive jurisdiction or regar- ded as a kind of exclusive jurisdiction. Considering the reason why exclusive jurisdiction rejects the application of a- greement jurisdiction is its public purpose, and considering the nature of the special jurisdiction of China, it is easy to find that the specific jurisdiction cannot be justified when it excludes the application of agreement jurisdiction. Therefore, both the relevant judicial interpretation rules and the judicial practice should be urgently corrected.
