合理使用制度不健全是制约我国图书馆数字化、网络化进程的主要法律瓶颈之一,具体表现为规制范围狭窄、缺乏灵活性、条款模糊笼统、限制条件多、适用风险较高等。提出创新我国图书馆版权合理使用制度的建议,即重申合理使用规则的有效性、采取开放立法、提高规定的强制性以及增加立法的明晰性等。

Imperfect use system, one of the main bottlenecks that constrain the digitalization and network process of domestic libraries, is featured by the following aspects： narrow regulation range, lack of flexibility, fuzzy general terms, too much restriction, and high risk in application, etc. The innovation of library copyright reasonable use system includes the validity of the rational use of the rules, the adoption of open legislation, the improvement of the mandatory provisions, as well as the clarity of the legislation.
