核损害赔偿国际立法对我国的启示

Implication of International Legislation on Nuclear Damage Compensation on China

核能的发展虽然给解决环境问题带来希望,但也不能忽视核事故发生对环境造成的严峻后果。为应对核事故发生后的损害赔偿,国际社会和世界主要有核的国家对核损害赔偿责任制度均已建立起较为完善的体系。针对我国核损害赔偿责任制度的不足,借鉴国际公约和日本核损害赔偿机制,建议尽快颁布《原子能法》、构建多样化的核损害赔偿救济机制,以此完善我国核损害赔偿制度。

Although the development of nuclear energy can bring hope to solve environmental issues, it cannot be denied that the happening of nuclear accidents will cause serious consequences to the environment. In order to deal with damage compensation after nuclear accidents, the international community and major countries owning nuclear energy have established comparatively complete systems for the liability system of nuclear damage compensation. In terms of the shortages in China＇ s liability system of this aspect, the paper, referring to the international conventions and Japanese nuclear damage compensation mechanism, suggests promulgating Atomic Energy Act and constructing diversified relief mechanisms of nuclear damage compensation so as to improve China＇s nuclear damage compensation system.
